Whenever the negligence, omission or other tortious action of one person causes the death of another, in a car accident, a fall, a workplace accident, or in any other type of accident, or through medical malpractice, the decedent’s representative can commence a lawsuit on behalf of the decedent's family. A wrongful Death claim is usually sought by the family members who seek a recovery of money due to the pain and suffering of their departed loved one, or who have lost a considerable amount of money as a result of the death, or by the parent who has suffered the loss of a child, or by a child who has suffered the loss of a parent, or by a wife or a husband who has suffered the loss of a spouse and spousal consortium. The family is no longer able to benefit from the wages earned by the decedent. Wrongful Death due to medical malpractice can be caused by the following: Surgical malpractice, medication errors, anesthesia errors, diagnostic errors. (Wrongful death suits can also result from non-medical causes such as: automobile / vehicular accidents, workplace accidents, personal injury accidents.) It should be noted that the victim's pain and suffering just prior to death is not part of a wrongful death case.
